Possesion confusion

I was in the parking lot of an apt complex and was approached by 3 undercover cops who initially approached me for expired plates (which i dont have) and then asked about marijuana and made me get out of the car. After they searched my car they gave me a ticket for possesion of marijuana, which was less then 2 grams and they said i would have to appear in court. I was just wondering what the fines are for a first time offender and if previous drinking tickets would count against me.

If you have prior "tickets" you are not a first time offender. Possession of 2 grams of cannabis is a Class C misdomeanor. That is a fine of up to $1,500.00, and up to 30 days in jail. Please call me for an appointment.

There may be a good "motion to quash arrest and suppress evidence", as the officers detained and interrogated you without cause. If that is so, the case may be dismissed after a successful motion. In the event that is not the case, there are other alternatives, possibly the State's Attorney's Drug School, attendance at which may lead also to a dismissal. The case itself is a Class "C" misdemeanor. The possible penalties are up to 30 days in jail, and or a fine of up to $1500.00.
