Legal Question in Criminal Law in Illinois
Pre-trial
My nephew has a pre-trial coming upon the 20th of this month, which is way past the 120 day deadline. What can be done with this and not getting the pre-trial within the 120 days?

Re: Pre-trial
When you say the 120 day deadline, I'm assuming the time the State must bring him to trial in regards to the speedy trial act. First, your nephew must be incarcerated for the 120 days. If he's out on bail bond, it's 160 days. That's only if he's demanded speedy trial in writing, and hasn't asked for a continuance, or agreed to one. I would need more information.
