Legal Question in Criminal Law in Illinois
what is public policy notice mean when being denied expungement?
1 Answer from Attorneys
Your question is brief but I believe what you are referring to is that when an individual files a petition for expungement, the clerks office will send notice to the state's attorney, the arresting agency and the Illinois State Police. Those bodies have 60 days to object to the expungement of your records. If any of these bodies objects to your expungement, a hearing date will be assigned and your petition will be heard before a judge to make the final determination.
I would recommend you hire an attorney for your hearing to ensure you provide a detailed, organized and compelling argument for your petition.
