Legal Question in Criminal Law in Illinois
My question is concerning Expungements in Chicago, Illinois.
I had my record Expunged last year and would like to apply to some Law Enforcement/FireFighter jobs. I noticed on some of the applications they ask to include Expungements when filling the background section.
What's the purpose of getting a record Expunged if they still ask and is it Legal for them to do so?
Also, are they still able to findout if you put no and you don't volunteer any information?
My understanding is that your record gets Expunged on the City, State, then the Federal level and only the FBI can go back and pull your information.
Thanks!
Terrell
1 Answer from Attorneys
Hi Terrell,
An expungement does not always remove all traces of your conviction. The FBI as you stated can still have access.
To become a police officer/firefighter, I'm sure they have access to your FBI file. To become an attorney you have to disclose all convictions even if expunged because your FBI file is looked at because Attorneys are "officers of the court" the same as police officers.
