Question regarding a Sex Crime

Hello,

In 2006, I was released from a GA prison after serving 3 years in prison for Sexual Exploitation of a Child. And was also given 12 years of probation for Statutory Rape. I was sentenced under GA's First Offender Act. And also the court said I did not have to Register as a Sex Offender.

Well I had my probation transferred to IL. IL made me register as a sex offender and told me that I would have to register for all of my life here.

Can IL make me register even though I did not have to register in GA? The law here says anyone ''convicted'' of a sex crime must register, but I was never ''convicted''. Can IL force my hand even though I never committed the crime in IL?

I would like to challenge the court system. I believe that since a judge in GA said that I DO NOT have to register as a S.O. then I shouldn't have to in IL either. And since I was never ''convicted'' the law in IL shouldn't be applicable to me. I want IL to honor my plea under the First Offender Act and no mandate that I register.

Please advise...

What you would probably have to do is challange the IL law in civil court in a declaratory judgment suit. I could help you, but it would be very expensive. Please call.
