Legal Question in Criminal Law in Illinois
I received a ticket for a traffic stop. After the stop, the car was searched and a small amount of marijuana was found. At the trial date, both the traffic ticket and possession charge were dropped. A week later the charge of possession was re-filed.
My question: Since the original traffic charge was dropped/dismissed, doesn't that have an effect on the subsequent charges resulting from the stop?

Your cititations were most likely "SOL"d. Stricken with Leave to reinstate. Meaning the State dismissed the charges but may still refile them later.
Take this seriously, you will be treated like the prior dismissal never occurred if in fact you were SOL'd.
I would recommend hiring an attorney. Retaining an attorney for relatively minor charges can be affordable, especially if the consequences of a conviction can be lifelong.
Tthe question is whether the officer had probable cause to stop you and also to search unless you consented to the search. In any event, you should hire an attorney.
