Legal Question in Criminal Law in Illinois
Just recently my dad got caught stealing something from menards for the amount of around $35 in Illinnois, this is his first ever time having a problem with the law and he is 55. So my question is what is more then likely going to happen to him?

In COOK County where I practice, most 1st time offenders for Retail Theft are offered Retail Theft School and Supervision.
I would at least consult with an attorney regarding your Dad's situation.

Mr Sheikh is correct. For a first retail theft offense (especially with your dad's age), at the very worst your father will likely receive court supervision which is not a conviction and is essentially good behavior. However, your father would have to wait 5 years before he can expunge his record.
A second outcome could be the court's Theft Deterrent program which allows your dad to go to a class and upon completion, he would return to the court, provide proof he took the class and the case would be dismissed.
Which outcome your father receives will depend on your attorney and the negotiations.
