Legal Question in Criminal Law in Illinois
Refunded Bond Money
A person is indicted for a violent crime. Bond is set and paid. Indicted person adheres scrupulously to conditions set by court. Person is convicted and receives long sentence. After serving a short part of sentence, conviction is overturned.
At the gate, prisoner is arrested again for same crime, jailed, and another (higher bond) placed.
Question: Is a (paid) bond ever refunded when conditions were explicitly observed, and why, and if yes, how can one actually receive it!?

Re: Refunded Bond Money
Hello- I have had a situation during my practice
where we had to petition the court for the bond
to be refunded to my client's father. This is
what you should do. You need a lawyer, in my opinion, to do this. Whether the office of
the sheriff for your particular county will
take steps to assist you is questionable!
