Legal Question in Criminal Law in Illinois

Remove offense from record of minor

I live in Freeport, Illinois with my 14 year old son Scott who was given a ticket for walking in the street, violation of a city ordinance, back in January. He thought it was a warning, threw the ticket away, and of course never told me. When he didn't appear for the scheduled court date on April 19, a warrant was issued for his arrest. I was not notified of this either. On Tuesday, the police went to the school, handcuffed him and arrested him. Only after he had been processed was I notified. After severely questioning their policy with regard to minors, a judged reopened his court to hear Scotts case and Scott was ordered to pay court costs.

I later received an apology and noted changes to their policy with regard to parental notification, since such minors cant even appear for sentencing without a parent or guardian present much less school dismissal.

And now to my question. This offense is now on Scotts record and although I am told that this will not come back to haunt him at a later date, I am very concerned that it could depending on what he may choose to do later in life. Is it possible to have this stricken from his police records, and if so, do I need legal council to do so or might I be able to handle this myself?

Re: Remove offense from record of minor

You can go to the clerks offfice where your son had his hearing and ask to file an expungement, while it is relatively simple there are certain rules which must be followed.

Or it can be filed by an attorney, in which case you know it would be down right the first time. Please e mail me if I may be of assistance.
