Legal Question in Criminal Law in Illinois
retail theft
my teenaged son was caught stealing $30.00 in merchandise from Sears. He was not arrested and I was able to pick him up from the store. I offered to pay for the stuff but was told it didn't make a difference. Now I recieved a letter from Sear's attonerys saying I have to pay $475.00 in ten days. Do I have to pay this? and if so why?

Re: retail theft
Did Sears file a civil suit against your son for the stolen merchandise? Also, did your son admit to the shoplifting? It seems to me, without having a chance to review the letter, that Sears is seeking to recover for compensation of the stolen merchandise. The amount is higher because it most likely includes attorneys fees. Would need to review the letter to answer in more detail. Good luck.
