Legal Question in Criminal Law in Illinois

sealing a conviction

I was convicted of carrying a unregistered gun. this happened in 1996, the law has changed since that conviction. What can I do to seal my record? I am having considerable trouble in finding employment. I have not been in trouble since that event. I had never been in trouble before that event. I have a post grad degree and I need help.

Re: sealing a conviction

The law now allows a convicted felon to seal his records. This is not an expungement, and it is discretionary with the court. Police agencies will still have access to your record. To learn more, please call for a free consultation.

Re: sealing a conviction

Generally felony convictions cannot be expunged or sealed unless they were under section 410 or 710 first offender probation for certain drug and prostitution cases in which case you must wait 5 years after termination of the sentence before seeking expungement/sealing of the criminal record. You want to seek out a possible clemency petition.

Goodluck. Email me with any questions.

Re: sealing a conviction

You do not say the nature of the charge. In 1996 the law on guns was different than it is now. It may have been a misdemeanor at the time (though not now). If it was it makes a lot of difference in your possibilities. Feel free to respond if you wish to talk about this situation without charge.
