Legal Question in Criminal Law in Illinois

search warrant

My brother was living in a camper owed by my mother, does the police have the right to search the camper without a search warrant? My Mother gave the officers permission to search, but my brother lived in it.

Re: search warrant

Issues concerning "consent to search" are fairly common in criminal cases. Whether or not your mother could give a valid consent depends upon several factors. Your question suggests the fact that something illegal was found and your brother is facing criminal charges as a result of the search. If the consent was invalid, the results of the search may be suppressed (kept out of evidence) upon a proper Motion and argument by your brother's attorney. Please have your brother seek legal advice on this issue from his attorney if he has one. If he does not already have an attorney, I have handled many criminal cases and would be willing to give your brother a free telephone consultation if he will call me at 314-727-2822. It may be that I can help him. Thanks, and good luck to your brother!
