Legal Question in Criminal Law in Illinois

Sentenced but not being transferred

My husband was arrested and charged with driving on revoked. He was sentenced Dec. 15, 2008 to 61 days in IDOC. He is still in the county jail so the time is not being counted against his 61 days since that is state minimum. Is there anything that can be done to get him transferred. Or can we get a new attorney to bring his case back up in court to have he released time served? His lawyer is not returning our calls and we have no where to turn.

Re: Sentenced but not being transferred

I am assuming that since your husband was sentenced to IDOC that he was convicted of felony driving on a revoked. The 61 days is not his sentence. He was sentenced to 1 year in IDOC. Of the one year he'll only serve 61 days. There must be a hold on your husband from somewhere. Have you inquired from CCDOC records office? If you need help, please call me.
