simple assault charges

a female co-worker is lying that i threated to bust her head if she did not join the union and particapate in a delegation march of 01/16/08, she also states that i threated to shot people if contract negatiation didnot go well, i did leave her a phone message that she let the police hear, the police states on the report that the message was unusal but not threating, is it possible to be convict because some one takes a few misplaced words and claim there scared? what is america come too

Assault is a Class A misdomeanor which carries a sentence of up to 364 days in jail and a fine of up to $2,500.00. You could be convicted if not properly represented. Many lawyers (especially the "cheap" ones) want your money and then plead you guilty. To be an assault, the offender must put the complaining witness in immediate apprehension of receiving a battery.
