Legal Question in Criminal Law in Illinois

my son, riding a 4-wheeler Saturday down a dead end road on the edge of town, with houses along it, hit a telephone pole that was placed from ditch to ditch on the road by a farmer to keep anyone away from his farm land road. The road is not owned by the farmer, it is used by the people that live on it and the pole was placed beyond the last house on the road. My son hit the pole with his 4-wheeler and was thrown 70 feet. He has a broken collar bone, broken elbow, deep cut to his head requiring 6 staples and other injuries. My question is....is the farmer libel for this and did he have a right to put the pole across the road? My son was heading west and the sun was in his eyes at the time.

Your son most definitely has a claim against the "farmer" for persoanl injury and pain and suffering.
