There is not a specific "vehicular assault" statute that you can be charged with. In Illinois, then a vehicle is involved in an assault or battery the charges are upgraded to aggravated assault or battery. The aggravation is the use of a potentially deadly weapon. An aggravated assault raises the charge from a class C misdemeanor (punishable by up to 30 days in jail) to a class A misdemeanor (punishable by up to 364 days in jail). An upgrade to a battery charge lifts the charges from misdemeanor to felony charges. Felony charges carry prison time.

If you are charged with any of these offenses it is vital you have an attorney representing you to get the charges reduced or fight the case.

good luck,
