Legal Question in Criminal Law in Illinois
Stolen beer out of garage
My son (18) and his friends stole a case of beer out of a garage. My son drove the car and the homeowner got his license plate so came to our house. They asked/took my son in to question. They're trying to find out who else was in the car. My son doesn't want to name his friends. Did he have to go with the police to the station? Can he leave freely? What can happen to me since it was my car? I wouldn't let them look in the car to see if the beer was there. I looked after my son left and there wasn't beer there. How long can they keep my son. What else can I expect or should we be doing? Help

Re: Stolen beer out of garage
The first thing you should be doing is hiring a lawyer to represent your son. He/she can go to the police station and talk to your son and the police and advise the police that he is represented by a lawyer. The lawyer can also advise you son of his rights.
You do not have to go with the police or remain with the police unless you are under arrest. If your son is not under arrest he is free to leave.
