Legal Question in Criminal Law in Illinois
tried to stop parent beating my niece, am listed as battery defendant now..what
I was at my sisters home on Christmas eve. The mother and daughter started arguing over gifts not received, then the father got involved. An argument between the father and daughter broke out. He started to punch her and I (the aunt) tried to stop his punches as did the mother. He punched me. He threw the mother and children out of the house. MY sister called the police. I left before the police arrived. The next day i found out he had my sister arrested for battery charges. I am named as a battery defendant. She has a court date, but what happens about me being on the report? I don't know if he filed this that evening or the following day. The children (2 sisters 12 & 14,) ran away Christmas eve after the mother was arrested because the father threatened the 14 year old. So they were missing all night from the house. They were at a neighbors house. The police called me the following morning asking me if the kids were with me. Anyway, The policeman told me that my sisters husband filed a battery complaint against me. I don't know what to expect or what to do.

In the first place it appears that you should hire an attorney to represent you in defense of the battery charges brought against you. In the second place, your sister should do the same thing but not with the same attorney. Also, the safety of your sister and the child seem to be at risk. Legal action should be taken to remove the violent person fromt he home and prevent him from any contact with either of the other victims, or you for that matter. I would certainly consult with an attorney in your area if I were you. Good luck
