Legal Question in Criminal Law in Illinois

Testimony

I am needed to testify in court on someones behalf but I am unable to make the court date. Is it permissible to write a letter of testimony on the individuals behalf and if so will it be looked on less favorable than a direct testimony to the judge.

Re: Testimony

Mr. Nack is right, you can't simply send a letter, because the prosecution cannot cross-examine a letter.

Re: Testimony

Have you been served with a subpoena to appear in Court? If so then you must appear. If you fail to do so then the court can issue an order that would work like an arrest warrant. You might call the attorney who had the subpoena issued and explain your situation. Perhaps the attorney could schedule your testimony around your other obligation. To answer your question, no, you can not simply write a letter.
