Legal Question in Criminal Law in Illinois
Ticket for Misdemeanor
My son is 18 years old and was recently given a ticket for posession of a tobacco pipe. It was for drug paraphanalia. How serious is this charge and what type of representation would require? He is a college student and has never been charged with anything before.

Re: Ticket for Misdemeanor
If all he got was a ticket, he is probably fine. Just make sure everything gets paid on time and that the ticket does not require anything other than payment.
The ticket will go on his record the same way a speeding ticket does. If you do not want this to happen or want to fight the ticket, you can hire an attorney to represent your son in court. If this is something you want to talk more about, please feel free to give us a call.
Re: Ticket for Misdemeanor
If a ticket was issued it is not a misdemeanor. It is an ordinance violation on the level of traffic tickets. Somtimes municipalities issue tickets for minor offenses instead of issuing a criminal complaint and arrest the person. It is basically a money maker for the municipality. Tell your son that he is lucky that the police did not arrest him for a criminal offense. Under those circumstatnces, he could spend up to 1 year in county jail, and be fined $2,500.00. Good luck.
Re: Ticket for Misdemeanor
Your son may or may not have been charged with a misdemeanor. As the other attorney said, if he was charged with a misdemeanor, he faces up to one year in jail and a fine of $2500.
The fact that he has no criminal history is good and can be used to negotiate a plea negotiation for him.
However, it is NOT best to just pay the ticket because (as was mentioned), it will leave a mark on his record.
Either way, I would go to court with an attorney.
