Legal Question in Criminal Law in Illinois
Time Allowed Before Charges Need to Be File
I was just curious what is the maximum length of time the police can hold you for questioning before they are required to charge you with a crime? I have heard 24,48,72 hours. I have also heard 48 hours without a warrant and 72 hours if they have a warrant. Can an attorney verify which one is accurate ?

72 hours is the Illinois court's interpretation of the statutory law which requires that arrestees be brought before a judge without unreasonable delay. Call us if you have any questions.
