When can time served be issued. Under what circumstances? Who has to ask, the client, the defense attorney or the judge?

Time served is a negotiated plea between the State's Attorney and the defense. Receiving time served is a conviction on your record but will avoid any additional jail time and will also avoid being placed on conditional discharge or probation. Receiving time served will all depend on your background, the charge against you and the facts of the case. Many prosecutors do not offer time served because there is no future consequence in their eyes, however certain cases (based on the facts of the case), are good candidates for time served.
