unfair

Hello, in 1999 I was charged in trespassing to land. I explained to the Judge that I was given a key to the premise He said that he would pass the case if I pleaded guilty and remove the charge from my record. Guess what it shows up. recently I submitted to a background check and the charged showed up as a conviction by mistake. So I might not get that job. What do I do, can I sue.

What needs to be done is to check the court records, and possibly order a transcript of the proceedings if they are available. You should see the circuit court clerk of the county in which the case took place, and ask to arrange to see the court file. This may require a wait, since the case is 6 years old. After looking at the file, and perhaps getting a copy of the records, if the court file does not reflect your recollection of the case, it may be necessary to get it back into court to correct the record. In Cook County, most misdemeanors also have court reporters and a record of the proceedings may exist. This can be ordered as well, and it may be needed to correct the record.
