Unlawful use of a Weapon
If an individual was arrested for a firearm that was not in his possession, no gun powder residue and no finger prints, but he/she has a non violent record could this person recieve a 6 to 30 year sentence @ 85% and shouldn't this case be thrown out?

Why exactly would a person be arrested for a firearm that was not in his possession? Not having a firearm in your possession was not a crime the last time I checked.
