UPS Theft

I am a student attending DeVry in Chicago, I worked at UPS for a couple months. I ended up attempting to have a box of PS2's sent to my apt, I never received the box, it was sent to the apt office. UPS found out and I admitted and retrieved the box. My question: My lawyer says its a easily beatable case because UPS cant charge me with theft because it was not UPS's property. which it wasnt. Is this true? Should I trust my lawyer?

It would appear that UPS had a greater right than you to be in possession of the property. Whoever has the legal right to possess property has the right to prosecute a theft claim against someone who came into possession with the intent to deprive the party with a right to possession permanently of that property. As it was entrusted to UPS for safe delivery, the company was the rightful possessor, if not the owner. I would suggest that you reconsider your defense in this matter.
