Legal Question in Criminal Law in Illinois
A warrant was issued for me for a traffic ticket driving on a suspended license failure to appear in court. I was suppose to pay 260 dollars of which 160 was still left to pay This happened in Illinois and I now live in Florida what are my opposition to now clear this up.
1 Answer from Attorneys
Your options to clear up your matter are as follows:
1. You can motion your case up in the courtroom the warrant is issued out of and ask for your warrant to be quashed and vacated. If this is granted by the judge, you can then pay the amount you owe and the case will be closed. Keep in mind that the judge may not quash the warrant and take you into custody.
2. You can ignore the warrant but if you are pulled over in Florida or other states the officer may see you have an outstanding warrant and arrest you on the spot.
3. You can hire an attorney to appear for you and complete what I've laid out in option #1. Some judges will allow the case to be resolved without you being there (since you now live in Florida) some may require your presence.
In my experience, an attorney will always have a better chance of having your warrant quashed and vacated.
