wife points to husband's crime
My friend comminted a serious financial crime years back which his wife knew about. Now wife threatens to tell the police if he were to divorce her. Can she do that, and is he really going to go to jail?

The statute of limitations for state crimes is 3 years, and federal 6 years. If this financial crime was ongoing, the RICO (Racketeering Influence and Corrupt Organizations Act) statute may come into effect. That has a statute of limitations of 10 years back from the last act, and 10 years forward. In other words, if the last act was within the last 10 years, the Feds can go back 10 years from that date to indict him for crimes committed. His wife can inform the authorities, but if the statute of limitations has run, they can do nothing. If this happens, your friend MUST have a lawyer. He should not weather this on his own.
