What will happen in court?
My boyfriend(R) is being charged with home invasion and aggravated battery. The victim in this case is R's sister's husband. The home invaded is both R's sister and victims home. R's sister gives R permission to enter the property whenever. Only the victim was home at the time of the incident. Can R still be charged with home invasion? Also, if victim does not show up will charges be dropped? There were no witnesses besides victim. If victim does show up to testify what could be the outcome?

Do not count on the victim not appearing to testify. The State's Attorney will send the victim a subpoena compelling him to appear. These are extremely serious charges. Your boyfriend is charged with a class X felony and may be sentenced to, not less than 6 years in prison and not more than 30 years incarceration. He needs an attorney to represent him.
