Legal Question in Criminal Law in Illinois
why did this work out this way
a week ago our doorbell began to ring, we did not want company. they gained access into our secure building and started pounding on our front door. after that we saw someone looking in our front room window, my husband and I were a little leary and nervous, a minute later they came back to our door and started coming in,my husband first reaction was to slam the door shut. When he did this it slammed on the persons head. we called 911, they ended up arresting my husband for battery and did not charge this person for coming into our home without permission. I called the chief of police and the states attorney they say I can not press charges. My husband was protecting himself and me from a unknown person coming into our home. Now he has to go to court, what can we do and why cant we make a complaint against her?

I don't know what county you're in, but in Cook County I don't know any judge who would find you guilty on those facts. You should have been able to file a complaint against her. I don't know why you weren't allowed to except the cop and prosecutor were lazy, or stupid, or both. Hire an attorney to protect you.
