Legal Question in DUI Law in Illinois

2 DUI's in 2 Different States

I was convicted of a DUI in Wisconsin last summer, and this past weekend I got another one in Illinois. I had fulfilled all of my counselling and suspension time and got an unrestricted license again. I read somewhere that Wisconsin is one of the few states that does not share traffic violations and records with other states. What do you know about this, and what am I looking at for possible fines and punishments? Is jailtime a possibility?

Wisconsin and Illinois share info. Your license should have been suspended by Illinois once it was notified of the arrest. The only exception I know is if you lived in Wisconsin at the time of the first DUI and then moved to Illinois. There would have been no reason to notify Illinois.

I suspect that Illinois would not know about the arrest if the above scenario is accurate. The bad news is that you will be required to sign certain documents and get an evaluation where you must disclose the prior arrest.

The bad news, is that being the case you are a 2 time DUI offender. If convicted you will be revoked not suspended. You probably are not eligible for a Judicial Driver's License. The fines and costs are going to be around $2500 and the lawyer's fee in the area of $2500. Your license will be revoked for a period of at least one year. Thereafter you must make an application to the Secretary of State for driver's privledges. Please call me for a free consultation 773 772-8989 Mike perez
