Legal Question in DUI Law in Illinois

aggravated dui and driving while revoked

Arrested for third dui in 1999, also driving on revoked.

Attended first court appearence, plead not guilty, did not

attend any othr hearings. Arrested on warrant in April

2003, charges are now upgraded to aggravated dui and

enhanced driving on revoked, my paperwork states i

was not a resident of Illinois since 2000, which I have

been. I have not left state, i have been in court for other

issues. Is there a statue of limitations for this charge

and how is it possible they are able to upgrade charges

to aggravated? Violations 625 ILCS 5/6-303(d) and 625

ILCS 5/11-501 (d)(1)(A). Is there chance of abolishing

these charges? Thank you!

You need to face up to these charges - you are likely to get some jail time. However, an attorney should be able to help you get some sort of leniency - possibly, for example, having the charges brought down to a less serious charge. You need an attorney or you will be facing much more serious issues than if you had not.
