I was arrested for a DUI after the officer suspected me of unusual operation because I turned into the private lot of a construction supply store and turned off my lights. When he asked me if everything was okay? I said yes. Then he asked if I had been drinking. I failed the field sobriety test but did not blow at the scene. Does this seem like a constitutional arrest?

When you do a DUI intake with a private attorney, they will likely give you an IICLE inspired intake form. It will have about, oh, 200+ questions. The answers to those questions will assist the attorney in deciding when and how to file applicable pre-trial motions. If you don't have an attorney, now is probably the time to consider getting one.
