I was arrested for dui but was not pulled over and was standing next to running car when police pulled up. Was questioned and admitted to drinking. Should I go to trial and fight this?

There is absolutely no doubt that you should hire an attorney. The attorney might be able to defend the charge based upon the idea that the oficer did not see you driving. But, the circumstantial evidence might provide enough for a jury to convict you. If so, the attorney should be able to negotiate a plea bargain that will avoid a conviction.
