Avoiding jail time

My husband;s nephew was given six months in jail for A DUI. He is thinking of leaving IL and going to IN to avoid doing his sentence. If he is caught will he be sent back to IL and will he get extra jail time. Will it also change the type of offense he has.

The attorney who responded previously gave a very good response, as he usually does!I would add that the state could also file completely new criminal charges against the nephew based upon his fleeing the jurisdiction of the court in order to avoid serving his sentence. It will be best in numerous ways for the nephew to face the music, do his time and try to clean up his life instead of making it worse.

There is likely to be the additional offense of violation of bail bond. Most bonds require compliance with court dates and staying within the jurisdiction. Should your nephew flee, there is likely to be a warrant for his arrest. At some time he will be picked up, held for extradition, sent back to Illinois and new charges filed against him. While waiting for this to happen he will not have a day of rest, whether for six days, six years or sixty years. He is much better off to do the six months.
