Can you be charged with DUI based on someone else's statement. there was a minor fender bender in an apartment building parking lot with 2 tenants (private prop). they exchanged information. the accused went home but the accuser called police. the accuser stated the accused "appeared" intoxicated. the police didn't contact the accused and did not speak to them even though accused was at home. The accused did not know police were there. there were no tests just the word of the person explaining the fender bender to police. can the police come back and charge with DUI? For the record the accused was not intoxicated but it a he said/she said case.
