I have a Pub. def. representing me on 12/2. I want the attorney to go to court for me and ask for a continuance but she says I don't have that right. Is this correct?
the reason I can't go is because I just started a new job, I have to take the alcohol eval. on tues and have court thursday of the same week, my job says if I miss even one day of training i can be fired.
ALSO....
what can I expect at the alcohol evaluation?
will they be testing for other substances besides alcohol?(i.e. marijuana)

You technically shouldn't miss the court date. However, if your lawyer explains to the judge that you will lose your job he/ she will be pissed but probably won't place a warrant for your arrest. Even if he does he will continue the warrant until the next court date to allow you to appear and show to the court that you really do care about your case.
The PD is rcorrect though. You do not have a right to miss court even if your attorney appears. The judge sees it as you are out of jail pending trial. You don't have to have a job or freedom.
All this being said I have appeared and explained your circumstances to the judge who reluctantly continued the case with out a warrant.

Your PD is correct in explaining that you do not have the right to miss court. There may be a way to address the matter however. The case can be advanced from Thursday to Tuesday (the same day as your evaluation). This way you can still make it to court and the evaluation and only miss one day of work that week. Your court date then could be rescheduled for the next month and you would not run the danger of having a warrant issued for your arrest. I was formerly a State's Attorney in the Bridgeview Courthouse and now that it is possible to have the case brought into court the same day. There will be a general illegal substance check on the date of the evaluation from alcohol to all illegal drugs. If you have further questions, the office number is 630-257-8280.
