Dropped Dui

My boyfriend received a DUI in April of 06' he was involved in an accident and the cops suspected him of being drunk. He refused the breathalizer and his license got taken away. This is his second Dui He had one about 4 years ago and that is all cleared up fines are paid etc. However this 2nd DUI was dropped in court. he doesn't have a 2nd DUI on his record he was found not guilty on all charges including the ticket for the accident. He has been without his license for a year. When can he get his license back? Please Help!

He has an issue involving a summary suspension for refusing the breathalyzer. When you refuse to take the breath test and it is within 5 years of a prior suspension, the new suspension is for three years, and there is no relief by way of limited driving privileges. There are always two matters going on with a DUI arrest, one is the criminal charge and one involves driving privileges.
