Legal Question in DUI Law in Illinois

Is a dui a felony in Illinois? I blew a .081 on the breathalizer, the legal limit is .080. Is there a possibillity to get this charged dropped? Thank you in advance.

DUI can be a felony given certain circumstances, but it is usually a misdemeanor. Whether any given DUI can be beat at trial (or dismissed before trial) will depend on any number of circumstances. There is no way for a lawyer to make any guarantee as to the outcome in any case.

It would be a good idea for you to find a lawyer in your area who offers a free consultation and then go talk to him or her.

I don't know why Jeremy Richie referred you to a web site that is a lawyer's referece cite forCentral Texas, but the rest of his response is correct. You should consult with an attorney to determine if there is any chance to defend the charge against you, and if not, to negotiate the best possible plea bargain. If this is your first such charge it is quite likely that you will be able to avoid a conviction at lease.
