in the state of georgia my husband got a dui. he has had several in the past. how long do they stay on your record? he says this is his first offence because the rest have expired. is this true? and what are the penalties for 1st offence now?

Under Illinois law, dui convictions stay on your record forever. If the new dui is his 3rd or better, it could be charged as a felony. The penalty is 1 to 3 years in prison. His Georgia dui convictions are taken into account here in Illinois. The state will try to use them against him. Those may have expired in Georgia but Illinois counts them. Also, your husband will be able to get probation with alcohol treatment, a large fine, and revokation of his drivers license. It will take years for him to get it back.
