Legal Question in DUI Law in Illinois

DUI 20 years ago

My father in law got a DUI about 20 years ago. Since,, he has not driven a motor vehicle, and has had an absolute clean record. Unfortunatly he never went to court for the DUI, and there is probably a warrant out for him. What is the easiest way to see if there is a warrant out for him. What are the steps to take in order to pay the penalty and obtain his liscence again, as he will now need it to provide for his family because his spouce just recently declared for disability.

Please help provide some direction for our family.

Where in Illinois did he get his DUI? My office can call the county clerk's office and investigate the situation. Please keep in mind getting his license back is a separate matter with the Ill. Sec. State's Off. and can be done only after the DUI is resolved.

If I were hired to help your father-in-law, I would interview him concerning the facts of his case. Then I would contact the clerk's office in the jurisdiction where he was originally charged and determine whether there was still an outstanding warrant and open file. Then, we could take steps to have the warrant cancelled and either defend or plea bargain the DWI. After all of these years it is possible that there will be no way for a prosecutor to get a conviction. After the DWI is disposed of, we can deal wtih the Illinois Secretary of State's office and perhaps also the licensing agency in Arizona to help him obtain the right to drive.
