Legal Question in DUI Law in Illinois

does record of dui in louisiana in 96 can be found anywhere?

i had a dui in Louisiana in 96. today i called to ask for my driving record and the say that my license number has been purged for clean record and not being active for long time (i moved to Illinois in 98). Can my LA DUI still show up anywhere if Illinois tries to find it as they are trying to convict me with dui here this year (2008). Is there anything i could do?

It can show up. There is nothing you can do about whether it shows up.

You should get a certified copy of your Louisiana driving record to be certain of your status. Generally as part of your drug and alcohol evaluation here in Illinois your out of state records will be provided to the evaluator. The records of that state is relied upon by the evaluator and ultimately the judge and the state's attorney. This can have a significant impact on your sentence and whether you can keep your driving privileges. The status of the LA case is governed by LA law and if it is removed properly pursuant to LA law, then it may not count against you. You should have a lawyer to represent you here in Illinois to properly protect your rights and driving privileges.
