Legal Question in Education Law in Illinois

child care discrimination

I have twins in day care. They are 4 1/2 yrs. old. Within the day care facility they have it structured by age groups, ie 2-3yrs, 3-4yrs, 4-5yrs, etc... My twins are older than the last five kids that were moved up to the next class. I talked to the director of this facility and she told me that in fact it is their co. policy to go by birth dates for advancement. Today I was told that a 3yr old just started the class.

I was told by the teacher of the 4-5 yr class that it was an Illinois mandate that the daycare structure was suposed to go by date of birth.

I need to know if this is true and if so what do I do to fix the problem.

Thank you for your attention to this matter!

Re: child care discrimination

Hello, and thank you for your

question. I can understand

your concern. I suggest that

you write the director and

requests that your twins be

moved to the proper age group.

If this does not lead to your

children being properly placed

at their age level, I suggests

filing a complaint with the

State of Illinois Department

of Professional Regulations.

Also, it may be a good idea

to get a letter to your State

Senator and State Representative. Letters are

better than phone calls. You

should c.c. a copy of the

letter to the day care director to your State Senator

and State Rep. for added

effect.
