Legal Question in Elder Law in Illinois

Caregiver of my Aunt but not Power of Attorney

My brother and I (nephew and niece) are the caregivers and only living relatives of my 83 year old Aunt and are being paid from my Aunt's bank account, thru her friend who is also my Aunt's Power of Attorney. Prior to my brother and I being her caregivers, my aunt was in a nursing home and paid the nursing home over $40,000 from Aunt's bank account, without my Aunt's knowlege. There is alot of things this POA is doing without consulting with my Aunt or us. Her Power of attorney will not tell us how much money my Aunt has in the bank. Her POA sold her condo without our consent or my Aunts and we do not trust her now. My Aunt told POA to distribute the money from the sale of the condo to us but she did not do it. We have asked POA how much cash she has in the bank but she will not tell us, only that it is in trust and POA is thinking of distributing some of my Aunt's money to us before she dies. How can we find out how much money my Aunt has in bank? And how can we legally pursue getting the money from the sale of the condo?

Your aunt can cancel the power of attorney at any time, if she is of sound mind. If not, then you may have to seek an accounting in court.

This is not legal advice. This is merely an answer to a question. Please seek legal advice from another lawyer before you act on this problem.
