Legal Question in Elder Law in Illinois

My dad

My dad is a severe alcoholic and in very, very poor health (can barely walk, just diagnosed as mentally incompetent due to alcoholic dementia, boatload of other health issues). His present doctors put him in a nursing home and refuse to discharge him to a home; only a better nursing home. We are getting a second opinion from a new doctor but if she says he can go home (which is his drinking environment) and he starts having vodka delivered to the house, can we still be charged with elderly neglect even though we aren't the ones providing the alcohol?

I doubt it, as long as your not contributing directly to it. However, if your stating to a court, or some judicial officer that you will take on responsibility for him, OR you are getting any state aid for him, you may have problems.
