Legal Question in Elder Law in Illinois

Elderly parent

My mother has Alzheimer's. We have depleted all assests except her house in trying to pay for sitters in keeping her at home. If we have to put her in a nursing facility and sell the house. Is there anyway to quarantee she 1) won't loose the house (maybe not sell it), 2) ''gift'' so much to her children? Any suggestions will be appreciated. It is hard to see that she worked all her life and we have been fortunate to be able to keep her home w/personal sitters this long. I just hate to see her loose everything and by putting her in a facility will she have to loose the house or is there a way around that? Thanks

There are several different ways to approach this depending on what your intentions are and also depending upon what has happened previously.

1. Did any child live at Mom's house in the last two years

2. Does mom have any children under 18 years of age or a disabled child of any age?

3. Why do you want to keep mom's house after she is in the nursing home?

4. Is the house easily salable?

5. Are you and all of you siblings in agreement?

6. What estate planning documents are available?
