Legal Question in Elder Law in Illinois

I have a father with Dementia and Prostate Cancer, and a brother who is addicted to Heroin who is trying to take advantage of him while I am at work. The brother is 51 years old, will not work, and he is an ex-felon who likes to fight family. What can I do about this? I am 62 years old and I work - can't afford to take early retirement.

You should consider becoming your father's Guardian. By doing so, your father would no longer have direct access to his funds and your brother would not be able to get money from him when you are not around. Guardianship also would empower you to better protect your father if your brother becomes physically violent.

However, there are a lot of factors to consider in making this decision. I'd be happy to talk with you further about this. Feel free to call me for a free consultation.
