1 Answer from Attorneys
Generally it is advisable to place the property of a person afflicted with Alzheimer's Disorder in a trust. Of course, such property should be placed in an appropriate trust prior to the diagnosis of AD. After diagnosis the issue of mental capacity may affect any execution of legal documents. After diagnosis the property can be placed in a trust by a guardian or person with such legal power under a durable power of attorney. There are many related issues depending on the specific situation of the individual, estate, co-owners, etc. This information is intended as general legal advice. You are advised to discuss the specific case with an attorney experienced in elder law.
