Legal Question in Elder Law in Illinois

info on elder estate

I have a friend who has property in trust to him from his girlfriend of 25 yrs . He forgot what will happen to her if he dies first, he has asked me to become her guardian and wants to give me power of attorney to take care of her in case something happens to him. She has no family. He also wants to give me her house if she dies . iI am have no idea if this is going to be a problem . He is 87 and in very good health and as sharp as a tack . She is frail and has mild dementia . He has a power of attorney over the entire estate . I am just a friend . I dont want any problems. there is enough money to maintain her home and have a 24 hour nurse to care for her, So what is it I will need to help her maintain her ability to keep her in her home . and since I gave my word to help them both what do I need to do to keep my word and assist them both. He has a family if she passes on and they will care for him . It is her that he is worried about. I don't like breaking my word . But I am confused on what I need to do. There re no relitives for her and it is very sad.

This older man cannot give you her power of attorney. He can only give you his power of attorney. Powers of attorney must comply with Illinois law. You should look into becoming the woman's guardian. If she has family, they may object. Please seek advice from a local attorney.
