Legal Question in Elder Law in Illinois

What does the law say about nursing home accidents? My grandmother was in a facility had limited mobility but otherwise healthy for the age of 94. She was dropped while being brought back to her bed and broke her leg. She would not survive surgery on the leg and we lost her last night after two weeks of pain. One family member talked to an attorney and was told since no one witnessed it, there is no case. The nursing home did their investigation for the state and concluded that 3 people did not procede with reports and lies were uncovered. Do we have a case?

I don't know whether you have a case or not but it seems to me that the very fact that your GM was injured while in the care of the nursing home is sufficient evidence to prove negligence. I don't know why you would even need a witness and given the fact that the potential witnesses are either senile or employees of the facility, I doubt that anyone would ever be able to find a witness in such an event.

I suggest you contact another lawyer. It sounds like the first one you talked to didn't want to be bothered.
