Mom's rights
My mother moved in to live with my brother and his wife 3 1/2 years ago. She gave them a large amount of money because they could not afford to buy the house without it. It was discussed that if she ever needed the money to move out to her own place or had to go to a nursing home she would get the money. There was a letter written up stating these facts and signed by all three parties. Her name is not on the deed to the house. She wants to leave and they want her to leave. They said they will get the money for her when she needs it. My question is: If she were to come down to Texas to visit for a few weeks, can they claim she has left the house potentially intending to move and somehow not give her the money and possibly move her things out to any place of their choosing? They have been very anxious for her to come to Texas to visit and very anxious to move her out. What are her rights?

Your mother has the right to seek to enforce her agreement with your brother. You should have a lawyer in the community where your brother lives review the letter. Call me if you want.
